Common Questions
 |
- What is credit repair
- Credit Repair is a generic term used to describe the process of removing inaccurate, outdated, misleading or unverifiable items from your credit report. It is sometimes referred to as credit report repair. Some leading credit experts estimate that up to 70% of credit reports contain errors in one form or another. Disputing these inaccuracies with the Credit Reporting Agencies (CRAs) whether performed by a consumer or by someone acting on their behalf, is credit report repair.
- Is credit repair legal
- Absolutely. Congress recognized the need for consumers to dispute information on their credit reports and passed the Fair Credit Reporting Act (FCRA). This legislation outlines the process a consumer would use to dispute questionable items on their credit report and the responsibility the Credit Reporting Agencies have to respond to the request.
- How much does our service cost
- If you calculate the difference between a 5% loan and a 12% loan you’ll quickly realize that the difference in interest paid is in the thousands of dollars. (See mortgage calculator) At Ascend Law, we charge a $75 set up fee and a monthly fee of $29.95. As you can see, this is a small price to pay for the potential savings of just one automobile loan.
- How long will it take
- There are several variables involved with this process. The most important item to understand is that at Ascend Law, we offer no guarantees of a timetable or a particular outcome. The number of negative items on a credit report will certainly play into how long the process will take. Another variable includes the number of delays the credit reporting agencies initiate with this process. At Ascend Law, we will work diligently to make this process as fast and friendly as possible. Each case is different just as any outcome in a legal court setting is different but in most cases, clients will see results within the first 60 days of sign-up.
- What kind of items can I dispute
- While Ascend Law can offer no guarantee of the removal of any item, we have had success removing the following items:
i. Late Payments
ii. Collections
iii. Charge offs
iv. Bankruptcies
v. Judgments and Liens
vi. Foreclosures
vii. Repossessions
viii. Incorrect personal information
- This list is certainly not all inclusive but it offers you a general guideline of those items that will be disputed on your behalf.
- Are you really a law firm
- Yes. Our directing attorney is M. Rick Erickson. We also have a staff of paralegals and support personnel that all work together to provide you the best possible results. Not only do we accept credit report repair cases, Mr. Erickson is a former defense attorney and a prosecuting attorney. He has experience in family law, divorce law and custody issues. He has also handled general civil litigation and personal injury cases. Rest assured that you will be afforded all the benefits of an attorney/client relationship.
- What are the advantages of using a law firm
- Over the last couple of decades, credit repair companies have promised and guaranteed results for consumers that quite frankly, were just false. These opportunists simply took your money without achieving any of their so called promises. As a result, congress passed laws and regulations regarding what these credit repair companies could and could not do. (see Credit Repair Organizations Act). When you sign up with Ascend Law, not only do we adhere to those laws enacted under the Credit Repair Organizations Act (CROA) we fall under the direction of the Utah State Bar association. We are being held to a much higher standard than a simple credit repair company. We are required to adhere to a higher standard in business and specific rules of professional conduct. Your privacy and confidentiality will always be maintained as it would with any law firm.
- Can I do this myself
- Yes. In principal, the process of disputing negative items on your credit report is relatively simple. Where Ascend Law offers an advantage is that we know the process of credit report repair. We have many clients who have told us that they have tried disputing items with the bureaus but it was a cumbersome, time consuming process that yielded very little results. Through technology, experience and expertise we provide you with an assurance that as updates are received, we will be fighting in your behalf with the bureaus at every opportunity.
- What is your refund policy
- At Ascend Law, we zealously strive to serve our clients and to ensure that they receive the finest representation possible. Because each client’s needs are specific to their respective case, Ascend Law cannot guarantee a specific case outcome or accurately predict how long it will take. If however you should wish to terminate our representation for any reason, Ascend Law provides the following refund conditions. First, you should know that Federal law specifically allows you to cancel this Agreement without any penalty or obligation, at any time before midnight of the 3rd day which begins after you have signed this Agreement retaining Ascend Law to represent you. This gives you a three-day window of opportunity to terminate Ascend Law’s representation with no penalty to you whatsoever. Ascend Law will refund the money you paid to retain our firm to represent you in full, no questions asked. After that time, the following conditions apply in order to receive your refund:
- You must have been a client with Ascend Law for a minimum 12 months.
- You must have provided regular credit updates to our firm pursuant to the retainer agreement.
The initial set-up fee of $75 is non-refundable after the “opt-out” period lapses. Ascend Law will calculate the amount to refund you based on the percentage of work that our firm has performed on your behalf.
